Sticomax has adopted this Privacy Policy to transparently inform Users about the website hosted at the following address: sticomax.com, ], (hereinafter referred to as the “ Website”), and about how personal data is collected and processed by Sticomax.
The term "User" refers to any user, whether a natural or legal person, who visits or otherwise interacts with the Website.
In its capacity as data controller, Sticomax determines the purpose of all the technical, legal and organisational means for processing Users’ personal data. Sticomax undertakes to take all necessary measures to ensure that the processing of personal data is carried out in accordance with the Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data (hereinafter referred to as the "Act") and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (i.e. the General Data Protection Regulation, or ‘GDPR’; hereinafter referred to as the "Regulation").
Sticomax is free to appoint any natural or legal person to process Users’ personal data at its request and on its behalf (hereinafter referred to as the “Processor” or “Subcontractor”). Where applicable, Sticomax undertakes to select a Processor that provides sufficient guarantees regarding the technical and organisational measures for the processing of personal data, in accordance with the Act and the Regulation.
2. Processing of Personal Data
A User’s use of the Website may result in the collection of personal data. The processing of such data by Sticomax, in its capacity as Controller, or by service providers acting on behalf of and under the authority of Sticomax, shall be carried out in accordance with the Act and the Regulation.
Personal data shall be processed by Sticomax, for the purposes set out below, using the following methods:
- Newsletter subscription forms
- Contact forms
- Product purchases
- Creation of user accounts
- Cookies
3. Purpose of Personal Data Processing
In accordance with Article 13 of the Regulation, the purposes for which personal data is processed are communicated to the User. These purposes are as follows:
- To ensure the proper provision of the services offered on the Website
- To comply with legal obligations regarding data retention
4. Personal Data That May Be Processed
By visiting and using the Website, the User consents to the collection and processing by Sticomax of the following personal data:
Information provided by Users when completing a contact or purchase form, including: Surname, first name, address, company, position, telephone number, email address, interests
Sticomax collects and processes such personal data in accordance with the terms and principles set out in this Privacy Policy.
5. Consent
By accessing and using the Website, the User declares that they have read and freely, specifically and unambiguously consented to the processing of their personal data, and that their decision was made on a well-informed basis. This agreement relates to the contents of this Privacy Policy.
Consent is given through a positive and active action by which the User ticks the box referring to the Privacy Policy (hyperlink). Such consent is an essential condition for performing certain actions on the Website or for enabling the User to enter into a contractual relationship with Sticomax. Any agreement between Sticomax and a User concerning the services and goods offered on the Website is subject to the User’s acceptance of the Privacy Policy.
The User agrees that the Controller, in accordance with the terms and principles set out in this Privacy Policy, may collect and process their personal data provided on the Website or in connection with the services offered by Sticomax, for the purposes described above.
The User has the right to withdraw this consent at any time. Such withdrawal of consent does not affect the lawfulness of processing carried out on the basis of prior consent.
6. Retention Period of Users’ Personal Data
In accordance with Article 13(2) of the Regulation, the Controller shall retain personal data only for as long as reasonably necessary to achieve the purposes for which this data was processed.
This period will never exceed two years.
7. Data Recipients and Disclosure to Third Parties
Personal data may be disclosed to employees, collaborators, subcontractors, processors or suppliers of Sticomax, provided that adequate guarantees for data security are in place and that they cooperate with Sticomax in the marketing of products or the provision of services. They act under the direct authority of Sticomax and are, in particular, responsible for the collection, processing or outsourcing of such data.
In all cases, the recipients of the data and any third parties to whom the data is disclosed shall comply with the provisions of this Privacy Policy. Sticomax shall ensure that such data is processed only for the intended purposes and in a secure and confidential manner.
In the event that data is to be disclosed to third parties for direct marketing or prospecting purposes, the User shall be informed in advance so that they can provide prior and explicit consent to such use of their personal data.
8. Users’ Rights

a. Right of Access
In accordance with Article 15 of the Regulation, Sticomax guarantees Users the right to access their personal data. Users have the right to obtain access to their personal data and the following information:
- The categories of personal data concerned
- The recipients or categories of recipients to whom the personal data have been or will be disclosed
- Where recipients are located in third countries or are international organisations, the appropriate safeguards in place
- If possible, the envisaged retention period for the personal data, or, if this is not possible, the criteria used to determine that period
- The existence of any automated decision-making, including profiling, as referred to in Article 22(1) and (4) of the Regulation, and, in such cases, relevant information about the logic involved, as well as the significance and expected consequences of such processing for the data subject
The Controller may charge a reasonable fee to cover the administrative costs of providing any additional copies requested by the User.
If the User makes this request electronically (e.g. by email), the data will be provided in electronic form and in a commonly used format, unless the User requests otherwise.
The copy of the data will be provided to the User no later than one month after the request has been received.
b. Right to Rectification
Sticomax guarantees Users the right to correct and delete their personal data.
In accordance with Article 16 of the Regulation, incorrect, inaccurate or irrelevant data may be corrected or deleted at any time. Users should first make the necessary changes through their user account, unless this is not possible, in which case the request can be submitted to Sticomax.
In accordance with Article 19 of the Regulation, the Controller shall inform any recipient to whom the personal data has been disclosed of any rectification, unless such rectification proves impossible or would require disproportionate effort. The Controller shall provide the data subject with information about these recipients upon request.
c. Right to Erasure
Users have the right to have their personal data erased as soon as possible in the cases specified in Article 17 of the Regulation.
Where the Controller has made the personal data public and is obliged to erase it under the previous paragraph, the Controller shall, taking into account available technologies and implementation costs, take reasonable measures, including technical measures, to inform other controllers processing such personal data that the data subject has requested them to erase any link to, or copy or reproduction of, such personal data.
The previous two paragraphs shall not apply to the extent that such processing is necessary for:
- the exercise of the right to freedom of expression and information;
- compliance with a legal obligation under Union or Member State law to which the Controller is subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Controller;
- the establishment, exercise or defence of legal claims.
In accordance with Article 19 of the Regulation, the Controller shall inform any recipient to whom the personal data has been disclosed of any erasure of personal data or any restriction on processing, unless such notification proves impossible or would require disproportionate effort. The Controller shall provide the data subject with information about these recipients upon request.
d. Right to Restrict Processing
Users are entitled to demand a restriction in the processing of their personal data in the cases specified in Article 18 of the Regulation.
In accordance with Article 19 of the Regulation, the Controller shall notify any recipient to whom the personal data has been disclosed of any restriction on the processing carried out, unless such disclosure proves impossible or would require disproportionate effort. The Controller shall provide the data subject with information about these recipients upon request.
e. Right to Data Portability
In accordance with Article 20 of the Regulation, Users have the right to receive their personal data from Sticomax in a structured, commonly used, and machine-readable format. Users have the right to transfer this data to another Controller without hindrance from Sticomax, in the cases provided for in the Regulation.
When a User exercises their right to data portability under the previous paragraph, they have the right to have personal data transferred directly from one Controller to another, insofar as this is technically feasible.
The exercise of the right to data portability is without prejudice to the right to erasure. This right does not apply to processing that is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Controller.
The right to data portability does not affect the rights and freedoms of third parties.
f. Right to Object and Automated Individual Decision-making
Users have the right to object at any time to the processing of their personal data on the basis of their specific situation, including automated processing by Sticomax. In accordance with Article 21 of the Regulation, Sticomax shall no longer process personal data unless there are legitimate and compelling reasons for the processing that override the interests, rights and freedoms of the User, or for the establishment, exercise or defence of legal rights.
Where personal data is processed for direct marketing purposes, Users shall have the right to object at any time to the processing of their personal data for such purposes, including profiling insofar as it relates to such marketing.
Where a data subject objects to processing for direct marketing purposes, their personal data shall no longer be processed for that purpose.
g. Right to Lodge a Complaint
Users have the right to lodge a complaint regarding the processing of their personal data by Sticomax with the Data Protection Authority competent for Belgian territory. More information is available at the following website: https://www.dataprotectionauthority.be/citizen.

10. Limitation of the Controller’s liability
The Website may contain links to other third-party websites that are not affiliated with Sticomax. Sticomax cannot be held responsible for the content of these websites or for their compliance with the Regulation and applicable law.
Holders of parental authority must provide their express consent before minors under the age of 16 disclose personal information or data through the Website. Sticomax strongly encourages those exercising parental authority over minors to promote responsible and safe use of the internet. The Controller cannot be held liable for the collection or processing of personal information and data of minors under 16 whose consent is not effectively provided by their legal guardians, nor for inaccurate information submitted by minors, particularly regarding age. Under no circumstances will personal data be processed by the Controller if a user indicates that they are under 16 years of age.
Sticomax is not responsible for any loss, damage or theft of personal data, including as a result of viruses or computer attacks.
11. Safety and Security
The Controller shall implement technical and organisational measures to ensure an appropriate level of security for the processing and collection of personal data. These security measures depend on the implementation costs in relation to the nature, context, and purposes of the processing.
The Controller uses standard encryption technologies commonly employed in the IT sector when transmitting or collecting data on the Website.
12. Amendments to the Privacy Policy
Sticomax reserves the right to amend this Privacy Policy in order to comply with applicable legal obligations. Users are therefore encouraged to consult the Privacy Policy regularly to stay informed of any changes or updates. Such changes will be posted on the Website or communicated by email to ensure that Users’ rights, including the right to object, remain effective.
13. Applicable Law and Competent Courts
This Privacy Policy is governed exclusively by Belgian law. Any disputes arising in connection with this Privacy Policy shall be submitted to the courts of the judicial district where Sticomax has its registered office.
